McDonald’s coffee was not just hot, it was scalding which makes it capable of almost immediate damage of skin, flesh and muscle.
Back in February 1992, In Albuquerque, New Mexico, Stella Liebeck, was in the passenger seat of her grandson's car when she was severely burned by McDonalds' coffee.
The 79 year old Stella Liebeck placed the cup of coffee between his legs in attempt to add cream and sugar to it. But as she removed the lid, the coffee spilled into her lap which caused her to suffered full thickness burns (or third-degree burns) over 6 percent of her body, including her inner thighs, perineum, buttocks, and genital and groin areas.
According to reports, McDonald’s have over 700 claims by people who were also burned by their coffee between 1982 and 1992. Other claims involved third-degree burns just like what happened to Stella Liebecks.
This history goes to show that McDonald’s has the knowledge about the extent and nature of this hazard.
McDonald’s also said during discovery that, based on a consultants advice, their coffee’s temperature is between 180 and 190 degrees fahrenheit to maintain most favorable taste.
McDonalds argued that consumers know that the coffee is hot and that its customers want it that way. However, they admitted that the consumer were unaware that they could suffer from third degree burns but they already placed a statement on the side of the cup. But it says ‘reminder’ not a ‘warning’ because the location of the writing would not warn customers of the hazard.
The jury awarded Liebeck $200,000 in compensatory damages. This amount was reduced to $160,000 because the jury found Liebeck 20 percent at fault in the spill. The jury also awarded Liebeck $2.7 million in punitive damages, which equals about two days of McDonalds' coffee sales.
